1. Acceptance of Terms

By accessing and using the Himalaya Holidays website and services, you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

These terms apply to all visitors, users, and others who access or use our services, including but not limited to booking travel packages, tours, accommodations, and related services.

2. Booking and Reservations

2.1 Booking Process

All bookings made through Himalaya Holidays are subject to availability and confirmation. A booking is only confirmed once:

  • You have received a written confirmation from us via email
  • The required deposit or full payment has been received
  • All necessary documentation has been provided

2.2 Booking Information

You are responsible for ensuring that all information provided during the booking process is accurate and complete, including:

  • Full legal names as per passport
  • Passport numbers and expiry dates
  • Contact information
  • Special requirements or medical conditions
  • Dietary restrictions or preferences

2.3 Travel Documents

It is your responsibility to ensure you have valid passports, visas, and any other required travel documents. Himalaya Holidays is not responsible for any issues arising from invalid or incomplete travel documents.

3. Pricing and Payment

3.1 Pricing

All prices are quoted in USD unless otherwise specified and include:

  • Accommodations as specified in the itinerary
  • Meals as indicated in the package details
  • Transportation as outlined in the tour description
  • Guide services where applicable
  • Entrance fees to attractions mentioned in the itinerary

3.2 What's Not Included

Unless explicitly stated, prices do not include:

  • International airfare
  • Travel insurance
  • Visa fees
  • Personal expenses (laundry, telephone, beverages, etc.)
  • Tips and gratuities
  • Additional activities not specified in the itinerary

3.3 Payment Terms

Payment must be made according to the following schedule:

  • Deposit: 25% of the total package cost at the time of booking
  • Balance: Full payment must be received at least 30 days before departure
  • Late Bookings: Bookings made within 30 days of departure require full payment at the time of booking

3.4 Accepted Payment Methods

We accept the following payment methods:

  • Bank transfer
  • Credit cards (Visa, Mastercard, American Express)
  • PayPal
  • Cash (for local bookings in Nepal)

3.5 Price Changes

Prices are subject to change due to currency fluctuations, fuel surcharges, taxes, or government-imposed fees. However, once a deposit has been paid and confirmed, your package price is guaranteed.

4. Cancellation and Refund Policy

4.1 Cancellation by Customer

If you need to cancel your booking, the following cancellation fees apply:

  • More than 60 days before departure: 10% of total package cost
  • 45-60 days before departure: 25% of total package cost
  • 30-44 days before departure: 50% of total package cost
  • 15-29 days before departure: 75% of total package cost
  • Less than 15 days before departure: 100% of total package cost (no refund)

4.2 Cancellation by Himalaya Holidays

We reserve the right to cancel any tour due to insufficient bookings, force majeure, or any other circumstance beyond our control. In such cases:

  • You will receive a full refund of all payments made
  • We will attempt to offer alternative dates or packages
  • No additional compensation will be provided

4.3 Refund Processing

Approved refunds will be processed within 14-21 business days using the original payment method. Bank charges or transaction fees are non-refundable.

4.4 Changes and Modifications

Changes to confirmed bookings may be subject to availability and additional charges. Contact us as soon as possible if you need to make changes to your booking.

5. Travel Insurance

We strongly recommend that all travelers purchase comprehensive travel insurance covering:

  • Trip cancellation and interruption
  • Medical expenses and emergency evacuation
  • Lost or delayed baggage
  • Personal liability
  • Adventure activities (if applicable to your tour)

Himalaya Holidays is not responsible for any costs incurred due to lack of adequate insurance coverage.

6. Health and Safety

6.1 Fitness Requirements

Certain tours require a good level of physical fitness. Please review the fitness requirements for your chosen tour and consult with your physician before booking if you have any health concerns.

6.2 Medical Conditions

You must inform us of any medical conditions, disabilities, or special requirements at the time of booking. Failure to disclose relevant health information may result in your removal from the tour without refund.

6.3 Vaccinations and Health Precautions

It is your responsibility to obtain information about required or recommended vaccinations and health precautions for your destination. Consult with your doctor or a travel health clinic well in advance of your departure.

7. Liability and Responsibility

7.1 Our Responsibility

Himalaya Holidays acts as an agent for various service providers including hotels, transportation companies, and local operators. While we carefully select our partners, we cannot be held responsible for:

  • Acts or omissions of third-party service providers
  • Changes in itinerary due to weather, political situations, or other unforeseen circumstances
  • Loss, damage, or injury to persons or property
  • Delays or cancellations beyond our control

7.2 Limitation of Liability

Our liability is limited to the total amount paid for your tour package. We are not liable for indirect, consequential, or punitive damages including loss of enjoyment, loss of income, or additional expenses incurred.

7.3 Customer Responsibility

You are responsible for:

  • Your personal belongings and valuables
  • Adhering to local laws and customs
  • Following safety instructions provided by guides
  • Obtaining necessary travel documents and insurance
  • Your behavior and conduct during the tour

8. Force Majeure

Himalaya Holidays shall not be liable for failure to perform any obligation under these terms if such failure is caused by force majeure events including but not limited to:

  • Natural disasters (earthquakes, floods, landslides)
  • War, terrorism, or civil unrest
  • Government actions or travel restrictions
  • Pandemics or health emergencies
  • Strikes or labor disputes
  • Any other circumstances beyond our reasonable control

In such events, we will make reasonable efforts to provide alternative arrangements or refunds as appropriate.

9. Behavior and Conduct

We expect all guests to behave respectfully towards fellow travelers, guides, local communities, and the environment. We reserve the right to remove from the tour any person whose behavior:

  • Endangers themselves or others
  • Causes distress or offense to other travelers
  • Damages property or the natural environment
  • Violates local laws or customs
  • Significantly disrupts the tour experience

No refund will be provided if you are removed from a tour due to inappropriate behavior.

10. Complaints and Disputes

10.1 During Your Trip

If you have any issues during your trip, please inform your tour guide or our local representative immediately so we can attempt to resolve the matter on the spot.

10.2 After Your Trip

If you wish to make a formal complaint after your trip, please contact us in writing within 30 days of the end of your tour. Include:

  • Your booking reference number
  • A detailed description of the issue
  • Supporting evidence (photographs, receipts, etc.)
  • Your proposed resolution

10.3 Resolution Process

We will acknowledge your complaint within 5 business days and aim to provide a full response within 28 days. If we cannot reach a mutually satisfactory resolution, you may pursue alternative dispute resolution or legal remedies.

11. Intellectual Property

All content on the Himalaya Holidays website, including text, images, logos, videos, and graphics, is protected by copyright and other intellectual property rights. You may not:

  • Reproduce, distribute, or republish content without written permission
  • Use our content for commercial purposes
  • Modify or create derivative works from our content
  • Remove copyright notices or attributions

12. Privacy and Data Protection

Your use of our services is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

By using our services, you consent to the collection and use of your information as described in our Privacy Policy and in accordance with GDPR and other applicable data protection regulations.

13. Photography and Marketing

During tours, photographs and videos may be taken by our guides or staff for marketing and promotional purposes. By participating in our tours, you consent to:

  • Being photographed or filmed during the tour
  • The use of such images in our marketing materials
  • Publication on our website and social media channels

If you do not wish to be photographed or have your images used for marketing purposes, please inform us in writing at the time of booking.

14. Special Requests

We will make reasonable efforts to accommodate special requests such as dietary requirements, room preferences, or accessibility needs. However:

  • Special requests must be communicated at the time of booking
  • We cannot guarantee that all requests will be fulfilled
  • Some requests may incur additional charges
  • Confirmation of special requests is not guaranteed until you receive written confirmation from us

15. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of Nepal. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Nepal.

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. The "Last Updated" date at the top of this page indicates when these terms were last revised.

Your continued use of our services after changes have been posted constitutes acceptance of the modified terms.
